Terms of Use

The rules for reading and sharing Tathmini Research. The most important one is in section 2: our reports are research, not personal investment advice.

1. About these terms

These terms govern your use of tathminiresearch.com and our emails (together, the "Site"), operated by Tathmini Research ("we", "us"). By using the Site or joining the waitlist, you agree to them. If you do not agree, please do not use the Site. You must be 18 or older to join the waitlist.

2. Research, not advice

• Tathmini Research is not licensed by the Capital Markets Authority as an investment adviser, fund manager or stockbroker, and does not hold client money or place trades.
• A verdict such as "WAIT" summarises our reading of the evidence at the date of the report. It is not personal advice.
• Share prices can fall as well as rise, dividends are not guaranteed, and past performance is not a guide to the future. You may lose money.
• Before investing, read the company's own documents in full and, if you need advice, consult a CMA-licensed investment adviser.
• Each report states whether Tathmini Research or its writers hold a position in the company discussed, and whether anyone paid us for it. We do not accept payment from companies we cover.

3. Accuracy and sources

We work from public sources: company filings, NSE announcements, offer documents and published research. We footnote them so you can check our working. We take care, but sources can be wrong and so can we. Figures may contain errors, forecasts are estimates, and reports are not updated after publication unless we say so. When we find a material error, we correct it and note the correction.

4. Using the Site

You may read, print and keep reports for your own personal, non-commercial use, and share links to them. You may quote short extracts with credit to Tathmini Research and a link. You may not:

• republish, sell or distribute full reports or substantial parts of them, including in paid groups, newsletters or chat channels;
• remove copyright or source notices;
• scrape the Site, or use it to build a competing product or train machine-learning models;
• interfere with the Site's security or operation.

5. The app waitlist

Joining the waitlist is free and does not commit you to buying anything. The unsubscribe link in our emails is personal to you: do not forward them. You can leave the waitlist at any time from any email we send. Early access is offered at our discretion and may be limited. We may remove sign-ups that appear fraudulent or automated.

6. Ownership

The reports, charts, text, design and the Tathmini name belong to Tathmini Research or its licensors and are protected by the Copyright Act, 2001 and other laws of Kenya. These terms give you no ownership rights; all rights not expressly granted are reserved.

7. Feedback

If you send us comments or suggestions, you allow us to use them freely to improve our research and the Site, without payment or attribution. Please do not send anything confidential.

8. Privacy

Our Privacy Policy explains how we handle personal data under the Data Protection Act, 2019, and forms part of these terms.

9. Links to other sites

Reports link to company documents, exchanges, brokers and news sites that we do not control. A link is not an endorsement, and those sites have their own terms and privacy practices.

10. Disclaimers

The Site is provided "as is" and "as available". To the extent the law allows, we give no warranty that the Site or any report is complete, accurate, current, uninterrupted or fit for any particular purpose. Nothing in these terms limits any right you have under the Consumer Protection Act, 2012 that cannot lawfully be excluded.

11. Limits on our liability

To the extent the law allows:

• we are not liable for any investment decision you make, or for any trading loss, lost profit or lost opportunity, whether or not you relied on our research;
• we are not liable for indirect or consequential loss;
• our total liability to you for any claim about the Site is limited to KES 5,000.

Nothing here limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited under Kenyan law.

12. Your responsibility

If you breach section 4, for example by republishing full reports, you are responsible for the reasonable costs and losses we incur as a result.

13. Changes and suspension

We may change, pause or close the Site or any part of it. We may update these terms; the date above will change, and we will email waitlist members about material changes before they take effect. If you keep using the Site after that, the updated terms apply.

14. Law and disputes

These terms are governed by the laws of Kenya. If you have a complaint, email us first: we will try to resolve it within 30 days. If we cannot, either of us may propose mediation. Failing that, the courts of Kenya at Nairobi have jurisdiction, including the Small Claims Court for claims within its limits. Nothing here stops you exercising rights you have as a consumer.

15. General

These terms and the Privacy Policy are the whole agreement between us about the Site. If a court finds any part unenforceable, the rest still applies. If we do not enforce a term, we have not waived it. Notices may be sent by email or posted on the Site, and electronic records are valid under the Kenya Information and Communications Act. You may not transfer these terms; we may transfer them to a successor who keeps them in force.
